Terms of Service

These Terms of Service govern your access to and use of the Ecodetect platform and the services operated by Ecodetect Ltd ("the Company") at inecodetect.com. By using the Service you accept these Terms. If you are using the Service on behalf of an organisation -- for example, an offshore wind operator, a marine inspection contractor, or a survey company -- you represent that you are authorised to bind that organisation to these Terms.

1. Agreement

These Terms govern your use of inecodetect.com and the Ecodetect inspection analysis platform (together, the "Service") operated by Ecodetect Ltd (Ocean Way, Ocean Village Innovation Centre, Southampton SO14 3JZ, United Kingdom). By using the Service you accept these Terms.

Nothing in these Terms limits your statutory rights as a consumer under the Consumer Rights Act 2015 or other applicable UK consumer-protection law.

2. Description of the Service

Ecodetect provides AI-powered computer vision analysis of remotely operated vehicle (ROV) footage submitted by offshore wind and marine infrastructure operators. The platform processes footage to identify and classify anomalies -- including corrosion, structural cracking, marine growth, and cathodic protection wear -- and generates structured inspection report drafts for review by qualified engineers. The Service is intended as a tool to assist professional inspection engineers; it does not replace the judgement of a qualified surveyor, and all inspection reports produced using the platform must be reviewed and signed off by a competent person before submission to any regulatory authority.

3. Use of the Service

  • You must be at least 18 years old or hold appropriate professional authority from your organisation to access the platform.
  • You agree not to use the Service unlawfully, to interfere with its operation, or to attempt unauthorised access to any part of the Service or its underlying systems.
  • You may not copy, scrape, or reverse-engineer the Service or its outputs except as permitted by applicable UK law.
  • You are responsible for ensuring that any ROV footage you upload has been lawfully obtained and that you hold the necessary rights and permissions to submit it for processing.

4. Intellectual Property

The Service, including its detection algorithms, report generation software, platform interface, and associated documentation, is owned by the Company or its licensors and is protected by UK and international intellectual property law. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose in accordance with these Terms and any applicable subscription agreement.

Inspection reports and anomaly data generated from your uploaded footage remain your property. The Company does not claim ownership of your inspection outputs. The Company retains ownership of the underlying detection models and platform software that produced them.

5. User Content

You are responsible for the accuracy and lawfulness of any footage, metadata, or other content you submit to the Service. By submitting content, you grant the Company a limited licence to use, store, and process that content for the sole purpose of providing the Service to you -- including running detection analysis and generating your inspection report outputs. We do not use your submitted footage or derived inspection data to train or improve our detection models without your explicit written consent.

6. Right to Cancel (Consumer Contracts Regulations 2013)

Where you enter into a paid distance contract with the Company as a consumer, you have a 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To cancel, email [email protected] with a clear cancellation statement before the 14-day period expires. We will process any refund due within 14 days of receiving a valid cancellation. Note that if you request the Service to begin within the cancellation period and processing has commenced, your right to cancel may be limited as provided by the Regulations.

7. Disclaimers and Statutory Rights

The Service is provided "as is" and "as available." The Company makes no warranty that the Service will be uninterrupted, error-free, or that detection outputs will identify every anomaly present in submitted footage. Detection outputs are probabilistic and must be reviewed by a qualified inspection engineer before use in compliance submissions.

Nothing in these Terms excludes or limits liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded or limited under English law. Consumer statutory rights under the Consumer Rights Act 2015 -- including the standards of satisfactory quality and reasonable care and skill where applicable -- are not affected by these Terms.

8. Limitation of Liability

To the extent permitted by law, the Company's total aggregate liability for any claim arising from or related to the Service -- whether in contract, tort (including negligence), breach of statutory duty, or otherwise -- will not exceed the greater of (a) the total fees paid by you to the Company in the 12 months preceding the claim, or (b) GBP 100, except for liability that cannot be limited under mandatory law. The Company is not liable for any indirect, consequential, or special loss, including loss of profit, loss of data, or regulatory penalties arising from reliance on platform outputs not reviewed by a qualified engineer.

9. Termination

The Company may suspend or terminate your access to the Service for material breach of these Terms, on reasonable written notice. You may terminate your account at any time by contacting [email protected]. On termination, the Company will delete your uploaded footage and derived data in accordance with the retention schedule in our Privacy Policy. Sections that by their nature survive termination -- including intellectual property, limitation of liability, and governing law -- will continue in effect.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales, sitting at Southampton, United Kingdom, have exclusive jurisdiction to settle any dispute arising from or related to these Terms or your use of the Service, subject to your right as a consumer to bring proceedings before the courts of your place of residence within the United Kingdom.

11. Changes

The Company may update these Terms from time to time. Material changes will be posted with a new "Last updated" date, and active platform users will be notified by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
